Very serious problem in the reborn world

Trademark turns into copyright if no one challenges it. However, we are all going to be challenging this via a class action suit. Right now they are searching out an Intellectual Properties Attorney to help reverse her trademark. GO FUND ME ACCOUNT TO FIGHT TRADEMARK
She hasn't been in the business long and hasn't a clue that we are Warriors.

There is an auction of hers on eBay right now. I read through the entire thing and the way she talks, like she is the first one to have ever done any of it. And then how she warns to buy no custom babies

I haven't been around here for that long. But custom babies make up a huge part of the business. Matter of fact, next year I'm going to start from my youngest up and have an artist (I want to be a good one ) do custom babies for me based off of baby pictures of my children. Custom babies does not mean they are fake or counterfeits, but means the artist paints and roots and sometimes clothes the sculpt according to the buyer's specifications. From what she writes in her auction, one would think all customs are fakes and put out there by sellers who are trying to scam others.

She talks about cable ties, belly plates, and some dolls having tummy and back plates which are tied together... as if she is the first person who has ever done it. And she includes extra cable ties in case the baby breaks. Hmmmm.

I'm not a mean hearted person. But it is obvious from her use of her trademarked words that she uses over and over in her auction, and in the overall wording of the auction... just that she knows exactly what she has done and it is most definitely NOT so counterfeits from China will be prevented from being sold. It's like she wants the world to think that she has invented herself "reborn baby dolls" and that she herself is the creator and only genuine manufacturer of "the original reborn".

The entire situation is just so sad.

Like is said somewhere above in this thread, I think best not to comment or send her mail or anything like that. No need to stoop to her level and be mean or nasty as her intentions obviously were and are (just as she said she would sell for a $price$ the trademark but didn't mention at all surrendering it). I guess she thinks she has found her way to become an instant millionaire by doing absolutely nothing but getting a trademark (with terms that have been used, most likely since she was a little girl herself but now she claims to have invented).

We've signed our petition and have raised over $5,000! And so we are coming together and handling this situation the right way. Let's keep doing that. I've donated what I can and if this is still going on and she fights I plan to donate more, as much as possible, as I can financially do so. It's just such a shame that this woman did this. I mean, even the kits she buys are marketed as "reborn kits". How is it that she makes "the Original Reborn" from "reborn baby doll" kits that have been around for years now? But claims to be the only one and original reborn baby doll artist who I guess invented the entire process? Not only that, but long before there were kits, people stripped and reborned regular baby dolls, using all the same terminology we do now, the same terminology she has now trademarked.

This can be what we all make of it. This can bring us all together, and we can turn bad into good. Time for everyone to come together and stand against it, as this is the biggest SCAM that has ever occurred in this genre of art. One that impacts ALL of us; sculptor, artist, and collector alike. I've seen lots of different threads on various scams since I've joined this community this past September, but this one truly takes the cake. Most get and take advantage of a person here, a person there. Not right at all. But this lady, she has gotten EVERYONE. I don't understand how she can even live with herself, especially if she is like us and has that nurturing love that we all do for God's smallest and most innocent, His babies. Probably why we all started collecting, started reborning, sculpting. Because we have a special place in our heart for babies. It's why I started collecting anyway, because I have such love for little ones, I work as a nanny (aupair), and always have loved babies since I was one myself.


Edit: Seems she used the word "onesie" in her auction. Just saying, isn't that trademarked???

One of my favorite things about collecting dolls and making dolls is making DOLL FRIENDS. This woman is "new" and has decided to do something so mean to doll artists that it will follow her forever.

Can someone show me where VERO uses a program for reporting auctions? The only info I can find is that the rights owner contacts them to remove an auction. If EBay is returning listing fees for those reported and removed, I can't imagine they are actively taking part in removing the auctions. Offering the program for rights owners is one thing, but why shoot yourself in the foot if no one is complaining about it?

Hmmmm, just looking at her listing again. Even though this doll is a baldie, she talks about rooting. She comes right out and refers to the rooting process as true "micro rooting" where hair "plugs" are inserted one to three hairs at a time! The entire rooting process takes just 1-7 hours????? Come on lady, quality rooting can take weeks (or longer).
I still find it interesting that she refers to the babies being painted by "our artists" which seems to say there are more than one person painting and may be an assembly line process.

No one can use the terms anymore, no one can even sell using the word "reborn". And so what she thinks will happen, that everyone in this industry... sculptors, artists, even clothing makers, who have always been self employed and used these very general and generic terms on a regular basis, that they will need to contact her so they can continue their own business and will need to work under her "umbrella" of what she has trademarked. Since she has exclusive rights to the terms, she plans to charge people so they can use "her trademarked terms" and work/market underneath her trademark. Essentially everyone in this industry would work for her.

I think that's where the word "our" comes in. There is no "our" yet, but she thinks there will be. She really thinks that everyone in the reborn community will assemble underneath her and what she has trademarked. She being the "boss", dictating who can or can't use "reborn", accepting (for a fee I'm sure) sculptors and artists to all work together underneath her and what she has trademarked.

She plays it off by trying to say that she did this to try and stop the counterfeiting/copying of sculpts that is so prevalent in China, and so she wouldn't let the China people work under her "umbrella", and everyone in the industry would be working together... all under "her" trademark. But it is pretty obvious why she is doing what she is, for her own selfish reasons and because all she can see right now is dollar signs. I mean, imagine having everyone in this industry, all the big name sculptors and artists, all being accountable to her because they have no other choice if they want to use the word "reborn" (which we all know has been in use for DECADES and that this woman did not invent the term and is hardly the first one to use it).

"Reborn" doesn't just apply to just dolls, "Reborn" is also a comic book, playing cards, action figures, etc its not just dolls.

Before selling dolls I sold a lot of other things on ebay and I have had listings removed by the Vero program. It was a person who actually contacted ebay to remove my listing, not a "program" that searches for it. I had proved that I was...

a) a member longer than they were on ebay &
b) had a listing that displayed what I was selling was way before they had obtained a copyright to the photo.

Ebay had to relist my item and remove that warning from my account.

All this can be done by the listings removed by this vicious woman by doing the same.

Contact ebay stating you have been a member longer than she has and then show them when she obtained the copyright which was just in 2015. If you can show them a listing you had prior, ebay cannot remove it.

So that is what I would start doing is putting the ™ after your nursery name and slogan. And by all means do a poor man's patent.

Under common law, all you need to do is be the first one to use it and you can have it as long as you want (assuming you continue to use and protect it). Inserting the “tm” symbol after the word lets you claim ownership – and once the public associates the mark with your particular goods or services, you’ve established a common law trademark.

I don't want to complicate things but am curious if per this thread, http://www.doll-fan.com/viewtopic.php?f=6&t=374974 , if the trademark holder is asking for ebay to take down auctions which do not infringe or use the mark of "reborn baby doll" if that helps. Should those who have been effected by erroneous take-downs be keeping track? Seems to me there is some potential abuse going on.

I use the terms "Reborn Baby" (I don't use the word "doll")in my title and the word "Reborn" is within my template. I can't seem to figure out how to get the "reborn" out of my template. I'm working under the HTML to try and find the correct insert, but I think I will lose my whole framing for the template. I will relist with different wording in my title by changing the words to Reborned/Rebirthed. Hope this will keep them off my butt.

Shannon, I would not allow her to pressure you to remove the words "reborn", "reborn baby" as those are NOT in violation of her trademark of "Reborn Baby Doll".

Your auction/listing may be pulled but just save your template/auction in a word document because you can easily dispute the removal and put your listing right back up with no violations to your account. If we all do this consistently, eventually she won't be able to keep up and she will just duck back into the hole she came from.

And then, when our awesome team of legal fighters get that trademark reversed, we will all continue on as we have for 2 decades. VICTORY!
